Direzione di ricerca

Read migrated_student and uc_receiving_education to compare the current gate with the education conditions described in the issue. Then inspect uc_receiving_education.yaml and test_uc_receiving_education_properties.py, including cases 33 and 42 and the existing oracle. Done means the new no-UC case matches the stated legal outcome, the maintenance-funded case remains protected, and the Working Tax Credit timing reflects reg. 8(2)(a).

Descrizione

uc_is_excepted_from_education_condition applies SI 2014/1230 reg. 60(1) to any claimant or partner whose family claims at the legacy closure and who didn't count as a qualifying young person on the migration day (migrated_student). Reg. 60(1) protects only a person who fails the education condition "on the migration day because the person is undertaking a full-time course", and points to UC Regs 2013 regs. 12(2) and 13 for that course.

For example, a single 18-year-old in North East England in 2026 takes a full-time non-advanced course with no maintenance funding, reports £1,000 of Working Tax Credit, earns £9,000, pays a council rent of £6,000 and claims at the closure (would_claim_uc false, would_claim_uc_at_legacy_closure true). Under the law:

  • On the migration day, the Secretary of State keeps them out of the qualifying young person definition (reg. 28) and UC Regs reg. 12(2) doesn't cover their course, so they meet the condition and reg. 60(1) doesn't reach them.
  • Their claim ends the tax credit award the day before the Universal Credit award would start (reg. 8(2)). From then reg. 28 no longer applies, and they don't yet receive Universal Credit, so UC Regs reg. 5(5) doesn't apply either. They count as a qualifying young person, and DWP treats them as receiving education (reg. 12(1A)).
  • DWP reads reg. 5(5) as following an entitlement found on another ground: in ADM E2093, a twin who has a child and gets Universal Credit stops counting, and the other twin still counts.

So DWP pays this person nothing unless a reg. 14(1) exception applies, such as having no parental support, for which the model has no input. The model pays them 12 × £338.58 + £6,000 − 55% × £9,000 = £5,112.96, because migrated_student holds. With would_claim_uc true and no closure claim, migrated_student reads false and the same person fails the condition.

A fix would:

  • Require, in migrated_student, a course that reg. 12(2) covers: a full-time course of advanced education, or another full-time course with a student loan or grant for maintenance (uc_receiving_education reads both). The same person with maintenance funding keeps the protection (case 42 of uc_receiving_education.yaml, £4,062.96).
  • Add this person as a case, with no Universal Credit, and move the same gate into the oracle in test_uc_receiving_education_properties.py.
  • Weigh Working Tax Credit before the closure. Once #2845 lands, is_qualifying_young_person_for_uc_education keeps a Working Tax Credit report on the first day of a claimant's award (case 33 of uc_receiving_education.yaml), and reg. 8(2)(a) has already ended that award.
