Descrizione

This issue narrows #1818's missing War Widow's/Widower's Pension exemption to the benefit cap, with a current Oxford example. #219 tracks the wider War Pension Scheme.

What the law says

The Universal Credit Regulations 2013 reg 83:

83.—(1) The benefit cap does not apply in relation to any assessment period where— …
(d) a claimant is receiving a war pension; …

(2) For the purposes of this regulation, "war pension" means—
(a) any pension or allowance payable under any of the instruments listed in section 639(2) of ITEPA—
(i) to a widow, widower or a surviving civil partner, or
(ii) in respect of disablement;
(b) a pension payable to a person as a widow, widower or surviving civil partner under any power of Her Majesty otherwise than under an enactment to make provision about pensions for or in respect of persons who have been disabled or have died in consequence of service as members of the armed forces of the Crown; …
(d) a pension paid by the government of a country outside the United Kingdom which is analogous to any of the pensions, allowances or payments mentioned in paragraphs (a) to (c).

Income Tax (Earnings and Pensions) Act 2003 s 639(2) lists the instruments. They include the Personal Injuries (Civilians) Scheme 1983 and the Naval, Military and Air Forces etc. (Disablement and Death) Service Pensions Order 1983. So DWP does not apply the cap to a claimant who receives a pension under one of those instruments as a widow, widower or surviving civil partner.

What the model does

In is_uc_benefit_cap_exempt_specified_benefit (policyengine_uk/variables/gov/dwp/universal_credit/benefit_cap/is_uc_benefit_cap_exempt_specified_benefit.py), the model lifts the cap when a claimant receives any benefit in CLAIMANT_BENEFITS: attendance_allowance, armed_forces_independence_payment, iidb and afcs. The comment above the list cites reg 83(1)(b) to (e) and names "a war pension, which includes the Armed Forces Compensation Scheme's guaranteed income payments". The model leaves off that list war_widows_pension, which it documents as the State Pension Credit Act 2002 s 17(1) "war widow's or widower's pension", the Family Resources Survey's benefit code 9. So a claimant who receives it stays capped.

Example

A run at policyengine-uk d5403d70a takes a lone parent in Oxford (South East region) in 2026. They are 35, with children aged 3, 5 and 8, no earnings, housing costs of £15,000 and council tax of £1,800. DWP's maximum amount is £31,040.64 and Child Benefit £3,268.20. Under the family cap outside London, £22,020, DWP cuts the award by £12,288.84 to £18,751.80.

£520 a year more of Cap reduction Universal Credit Oxford Appendix 3 income Weekly Oxford reduction
nothing £12,288.84 £18,751.80 £22,020.00 £423.46 £1,800
War Widow's Pension (the model) £12,288.84 £18,751.80 £22,540.00 £433.46 £1,800
Armed Forces Compensation Scheme £0 £31,040.64 £34,828.84 £669.79 £0

DWP counts neither payment as unearned income (reg 66(1) names neither), and under reg 83(1)(d) and (e) it applies no cap to a claimant who receives either. So under the law DWP pays the War Widow's Pension family as in the Armed Forces Compensation Scheme row, £12,288.84 more Universal Credit a year, and Oxford City Council then gives them no reduction.

What to change

  • Add war_widows_pension to CLAIMANT_BENEFITS, citing reg 83(1)(d) and (2)(a)(i), and name it in the variable's documentation.
  • Add a YAML case for a capped claimant who receives War Widow's Pension, with uc_benefit_cap_reduction of 0.
