Descrizione

NY Tax Law § 606(ggg)(1) (TAX 606, revision active 2026-09-04) denies the NYC school tax credit to dependents:

For purposes of this subsection, no credit shall be granted to an individual with respect to whom a deduction under subsection (c) of section one hundred fifty-one of the internal revenue code is allowable to another taxpayer for the taxable year.

The IT-201 instructions apply this to both components: a filer who "marked Yes at item C … indicating that you can be claimed as a dependent on another taxpayer's federal return" does not qualify for line 69 (fixed amount) or line 69a (rate reduction amount) (2025 IT-201-I, p. 20; the same wording appears in 2022–2024).

Neither nyc_school_tax_credit_fixed_amount_eligible nor nyc_school_tax_credit_rate_reduction_amount_eligible checks this. The model already has head_is_dependent_elsewhere, which NY uses for its standard deduction (ny_standard_deduction.py). So a filer who can be claimed as a dependent, such as a working student in NYC with their own return, gets the credit today.

Fix: require ~head_is_dependent_elsewhere in both eligibility variables, with a parameter-free statute citation, plus YAML tests showing each component is denied when the head can be claimed elsewhere and allowed otherwise. The joint-return case (§ 151(c) as applied to a spouse) needs a decision; IT-201 item C asks only about the filer.

Found while fixing the rate-reduction income test in #9712.
